Jared Sutton

Jared is a business litigator with a wide range of experiences across multiple industries. Clients turn to Jared because he’s a quick study and can develop a winning strategy regardless of the subject matter.  Although his primary focus in recent years has been real estate and intra-business disputes, Jared considers himself one of a dying breed of true generalists, handling matters across the dispute resolution spectrum, from high-profile internal investigations to class actions to federal and state court appeals.  He is capable of taking on – and resolving – any civil litigation matter that comes across his desk.

In the past decade, Jared has developed a strong reputation as a leading young litigator in Phoenix.  He has been recognized as a Southwest Super Lawyers Rising Star every year since 2016 and was recently named to the Best Lawyers in America for Commercial Litigation.

Some of Jared’s representative matters include:

  • Successfully appealed enforceability of late fee against borrower, resulting in published Arizona Supreme Court opinion regarding the enforceability of percentage-based liquidated damages.
  • Challenged on summary judgment purported reversionary interest that would have transferred title of client’s property back to seller upon annexation to a township. Result upheld on appeal.
  • Conducted highly sensitive internal investigations for public agencies, involving alleged misuse of public funds.
  • Eliminated on appeal a $1 million punitive damage award against insurer for lack of sufficient evidence.
  • Obtained summary judgment for a general contractor on a claim by a purported subcontractor that the general contractor had entered into an oral $80 million contract for a major infrastructure project.
  • Won appeal of trial court order that would have (if not reversed) vacated a protective order and allowed the public disclosure of his client’s trade secrets.
  • On a pro bono basis, pursued and won an appeal for an autistic minor whose benefits were revoked by the state, resulting in a published appellate opinion that clarified the notice requirements for the termination of disability benefits.

When Jared isn’t working for his clients, he’s spending time with his beautiful wife of 14-years, Adriana, and their three children. The Sutton family is consumed by baseball. Combining their love of the game with their love of travel, the Sutton family recently started a “Stadium Tour,” taking the kids to two or three stadiums every year until they see them all.
